1. Agreement
By requesting a key or using the API you agree to these terms on behalf of yourself and, if you name an organization, that organization (“you”). Stats Orb (“Stats Orb”, “we”) provides the API. If you don't agree, don't use the API.
2. Accounts & keys
- Give accurate sign-up information and keep your e-mail address current — it's how you sign in and how we reach you.
- One account per person or organization. Keys are confidential: you're responsible for all use of your keys, and you must not share them outside your organization or embed them where others can read them. Tell us promptly if a key may have been compromised, and revoke it.
- Free keys are approved at our discretion. We may ask for more information about your use.
3. Plans & permitted use
- Free plan: non-commercial use only — personal projects, academic research, teaching and journalism that isn't sold or behind a paywall. “Commercial” means use in or for a product, service or activity that earns money (including advertising, subscriptions, consulting or internal business use by a for-profit company). If your use becomes commercial, move to a paid plan.
- Developer and Business plans: use in your own commercial products and services, within your plan's limits.
- Data license: bulk data, exports and any rights to use the data to train or fine-tune machine-learning or AI models are available only under a separate written agreement, which controls if it conflicts with these terms.
- Within your plan you may display the data, transform it and combine it with other data in your applications, provided you follow these terms.
4. Attribution
On the free plan you must credit “Data: Stats Orb (statsorb.com)” in a reasonably visible way wherever you display or publish the data, with a link to https://www.statsorb.com where the medium allows. Paid plans are encouraged, but not required, to credit Stats Orb. Don't suggest that Stats Orb endorses you or your product.
5. Prohibited uses
You must not:
- use the data, in whole or in part, to train, fine-tune, evaluate or ground machine-learning or AI models, or to build datasets for that purpose, except under a data license;
- resell, sublicense, or redistribute the data in bulk or as a substitute for the API (for example a downloadable copy or a competing data feed);
- get around rate limits or quotas — including with multiple accounts or keys — or scrape the Stats Orb website instead of using the API;
- use the API for anything unlawful, to harass anyone, or in a way that could harm or overload our systems; or attempt to probe, scan or break the security of the service;
- misrepresent the data (for example presenting projections as certain outcomes) or remove attribution where it's required.
6. Fees & billing
- Paid plans are billed monthly in advance to the card you save with our payment processor, Authorize.net, starting the day you subscribe, and renew automatically each month until canceled. You authorize these recurring charges.
- Requests beyond a paid plan's daily limit (“overage”) are billed at the end of each billing period at $9 per 1,000 requests or part of 1,000. You can set a monthly overage spending cap in your account; requests that would exceed it are refused instead of billed.
- Upgrades take effect immediately and are charged pro rata for the rest of the period. Cancel any time in your account; your plan stays active until the end of the period you've paid for. Except where the law requires otherwise, fees already paid aren't refundable, including for partial months.
- Prices are in U.S. dollars and don't include taxes; you're responsible for any taxes that apply. We'll give at least 30 days' notice by e-mail before a price change takes effect for your plan.
- If a payment fails, API access is paused until it's resolved. Unpaid overage may be collected from your saved card.
7. Limits, monitoring & suspension
We meter requests per key and account and enforce the limits of your plan. To protect the service we may automatically suspend a key that shows signs of sharing, leaking or abuse (as described in the documentation), and we may suspend or end access that breaks these terms. We'll tell you why by e-mail where we reasonably can.
8. Changes & availability
We work to keep the API available and accurate but don't guarantee uptime unless a written agreement says so. We may change or add features. Changes that would break existing v1 integrations will come with at least 90 days' notice or in a new API version. We may update these terms; for material changes we'll e-mail you at least 30 days before they apply. Continuing to use the API afterwards means you accept the updated terms.
9. Ownership
Stats Orb owns the API, the ratings, projections and other data it produces, and the Stats Orb name and logo. Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the data you receive through your keys for the purposes allowed by your plan. Underlying game facts (such as final scores) aren't owned by Stats Orb.
10. Disclaimers
Ratings and projections are statistical estimates, not facts or guarantees, and they are not betting, investment or other professional advice. THE API AND DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT THE LAW ALLOWS.
11. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, STATS ORB WON'T BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA, AND ITS TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE API IS LIMITED TO THE AMOUNT YOU PAID US FOR THE API IN THE 12 MONTHS BEFORE THE CLAIM (OR US $100 IF YOU PAID NOTHING). Some places don't allow these limits, so they may not apply to you. You'll indemnify Stats Orb against third-party claims arising from your breach of these terms or your use of the data in your products.
12. Termination
You may stop using the API and close your account at any time (cancel any subscription first). We may end these terms or your access if you materially breach them, if required by law, or with 30 days' notice for any reason (refunding any prepaid fees for the unused period in that last case). Sections 4, 5, 9, 10, 11 and 13 survive termination.
13. General
These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules; consumers keep any rights their local law gives them. If a provision is unenforceable, the rest remains in effect. These terms, your plan and any data license are the entire agreement about the API. Questions: contact us.
